Main types of contract terms in English contract law

This article analyzes in detail main types of contract terms existing in modern English contract law. The author identifies three main types of contract terms: 1) express terms; 2) implied terms; 3) exemption clauses. Analysis of main types of contract terms is carried out in the context of contract construction as the unique function of British courts. It is concluded that judicial identification of each particular type of contract terms has a specific role.
