LEGITIMACY: THE CONCEPT AND CONCEPTIONS

The article is devoted to the study of legitimacy and its conceptions at the legal and philosophical-sociological level. The authors focus on the prevailing distinction between legal and moral legitimacy. The level of interaction between legal moralism and legal positivism is considered. On the basis of these two points of view, several radical and transitional approaches coexist. It should be noted that in the sphere of practical implementation, the balance/imbalance of the components of the concept of legitimacy leads to the fact that the government can be legal and illegitimate, legitimate, but illegal, as well as legal and legitimate.
