THE FIRST SYSTEMIC LAW IN RUSSIA: HOW THE ZEMSKY SOBORD ADOPTED THE CODE IN THE MIDDLE OF THE 17TH CEN-TURY

In the history of Russian legislation, one of the most important landmark events is the adoption of the Collected Code in 1649 - this act is unique in many re-spects. The article examines this thesis from several angles, with special attention paid to the fact that the draft Code was discussed in advance by representatives of different classes (with the exception, of course, of involuntary people and women, in accordance with the social relations that existed in the Muscovite state at that time), and then at a general meeting in the form of the Zemsky Sobor, the final decision was made, including the signatures of the participants of the coun-cil, which was also attended by the tsar. Such a legislative procedure, which had certain democratic principles, can obviously be considered a prototype of the modern legislative process. It is noted that the Code consists of systematically thematically arranged chapters, which was not the case before. This Code regu-lated various aspects of social relations, and in this context, this act was a uni-versal, extremely concise set of rules and norms of both substantive and proce-dural law. At the same time, there was a predominance of issues of a property and land nature. Many norms regulated the protection of the political system (the initial stage of absolutism) - for an attempt on the lives of persons of the highest nobility, crimes against the state, the death penalty was imposed. The same pun-ishment was for severe general criminal punishments; for the first time, punish-ment in the form of imprisonment appears. The Code was first reproduced in print. Accordingly, the norms of the Cathedral Code, other documents related to its adoption, scientific works that touch on this issue are analyzed, and the au-thor's generalizations are made.
