The author considers the philosophical and legal aspects of Y. Habermas' communicative concept in its relation to the actual problems of development of the Russian modern civil society. The article analyzes the theory of deliberative democracy based on discursive agreement on the most important issues of public life in Russia. It is emphasized that the peculiarity of the habermasian concept of consensus is that legal norms are voluntarily accepted by all members of society in the process of open discussion, and the significance of this principle for modern society is analyzed.
