This article analyzes contractual and unaccounted consumption of electric power as a significant legal and socio-economic problem of modern electric power industry. The basic concepts, types and causes of contractual and unaccounted consumption, as well as its impact on the activities of power supplying organizations and the sustainability of the electric grid complex are considered. A detailed review of the current legal and regulatory framework in the Russian Federation, including civil and administrative norms governing the relations on the supply and consumption of electric power, has been carried out.
Special attention is paid to analyzing the practice of law enforcement, including consideration of judicial precedents, examples of civil and administrative cases, as well as the role of energy companies in identifying and suppressing violations of contractual and unaccounted power consumption. Key problems of law enforcement, such as insufficient specification of concepts, difficulties in proving the fact of uncontractual and unaccounted consumption of electricity, technical limitations of metering systems and insufficient level of liability for violations, were also outlined.
The paper offers recommendations for improving the regulatory framework, including the introduction of unified methods for calculating damages, tougher sanctions, introduction of modern intelligent electricity metering systems with remote monitoring and increased accessibility of contracting for electricity consumers.
The results of the conducted research can be used in rule-making activity, law enforcement practice and scientific developments in the field of energy and civil law.
